## Section 1 — Introduction and Scope

This Privacy Policy describes how Bartosz Garliński Koncept ("Operator," "we," "us") collects, uses, stores, and shares personal data in connection with the operation of *The Tangible Assets Journal* ("the Service").

This Policy applies to personal data processed through:

* The Journal's website and blog operated on WordPress;
* The subscription and access management platform Zanfia;
* The payment processing service Stripe;
* The email delivery platform MailerLite;
* Analytics and tracking tools, including Google Analytics and Meta Pixel.

This Policy is issued in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council (the General Data Protection Regulation, "GDPR"), and applicable Polish data protection law, including the Act of 10 May 2018 on the Protection of Personal Data.

## Section 2 — Data We Collect and Why

We collect only the data necessary to operate the Service. For each category of data we process, the purpose and legal basis under GDPR Article 6 are set out below.

**Email address** Purpose: Delivery of the newsletter; account creation; service communications (billing, policy updates). Legal basis: Art. 6(1)(b) — performance of contract.

**Payment data (card number, billing details)** Purpose: Processing subscription payments via Stripe. We do not store card data — it is processed directly and exclusively by Stripe. Legal basis: Art. 6(1)(b) — performance of contract.

**Subscription status and plan history** Purpose: Access management, billing cycle tracking, renewal notifications. Legal basis: Art. 6(1)(b) — performance of contract.

**Email engagement data (opens, clicks)** Purpose: Delivery optimisation and understanding which content is most useful to Subscribers. Managed by MailerLite. Legal basis: Art. 6(1)(f) — legitimate interest in improving the Service.

**Website usage data (IP address, browser type, pages visited, time on page)** Purpose: Website analytics and performance monitoring via Google Analytics. Legal basis: Art. 6(1)(a) — consent (via cookie banner).

**Behavioural and advertising data** Purpose: Audience measurement and advertising optimisation via Meta Pixel. Legal basis: Art. 6(1)(a) — consent (via cookie banner).

**IP address and technical logs** Purpose: Security, fraud prevention, and debugging. Legal basis: Art. 6(1)(f) — legitimate interest in security.

We do not collect sensitive personal data as defined in GDPR Article 9 (such as health data, political opinions, or biometric data). We do not knowingly collect personal data from minors in a manner that would require special safeguards beyond what is already provided by our payment and subscription platforms.



## Section 3 — Cookies and Tracking Technologies

Our website (WordPress) and the Zanfia subscription platform use cookies and similar tracking technologies. The following are in use:

**Google Analytics (\_ga, \_gid, \_gat)** Type: Analytics Purpose: Measuring website traffic, user behaviour, and content performance. Provider: Google LLC, United States.

**Meta Pixel (\_fbp, \_fbc)** Type: Advertising / analytics Purpose: Measuring ad campaign performance; building advertising audiences on Meta platforms. Provider: Meta Platforms, Inc., United States.

**Session and functional cookies** Type: Necessary Purpose: Maintaining login state, CSRF protection, and basic platform functionality. Provider: WordPress / Zanfia.

**Stripe cookies** Type: Necessary Purpose: Payment session management and fraud prevention. Provider: Stripe, Inc., United States.

### Your choices

When you first visit our website, a cookie consent banner allows you to accept or decline non-essential cookies (analytics and advertising). You can change your preferences at any time via the cookie settings link in the footer of the website. Declining cookies will not affect your ability to subscribe to or receive the Journal.

You may also control cookies through your browser settings. Note that blocking all cookies may impair the functionality of the payment and subscription platforms.



## Section 4 — Third-Party Data Processors

We share your personal data with the following third-party processors, who act under our instructions and in accordance with their own data processing agreements.

**Zanfia** Role: Subscription and access management platform. Location: EU / EEA. Data shared: Email address, subscription status, plan details.

**Stripe, Inc.** Role: Payment processing. Location: United States. Data shared: Email address, payment card data, billing address.

**MailerLite UAB** Role: Email delivery platform. Location: Lithuania (EU). Data shared: Email address, name (if provided), email engagement data.

**Anthropic, PBC** Role: AI content generation (newsletter content only). Location: United States. Data shared: No personal data of Subscribers is shared with Anthropic. Content is generated without Subscriber data as input.

**Google LLC** Role: Website analytics (Google Analytics). Location: United States. Data shared: Anonymised and pseudonymised website usage data; IP address (truncated).

**Meta Platforms, Inc.** Role: Advertising analytics (Meta Pixel). Location: United States. Data shared: Website behavioural data and advertising identifiers (only with your consent).

**Automattic, Inc. / hosting provider** Role: Website infrastructure (WordPress). Location: United States / EU. Data shared: Technical logs, IP address.

We do not sell personal data to third parties. We do not share personal data with third parties for their own independent marketing purposes.



## Section 5 — International Data Transfers

Several of our processors — including Stripe, Google, Meta, Anthropic, and potentially the WordPress hosting infrastructure — are located in the United States. Transfers of personal data to these processors are made subject to appropriate safeguards as required by GDPR Chapter V:

* **Stripe:** EU Standard Contractual Clauses (SCCs) and, where applicable, the EU–US Data Privacy Framework.
* **Google:** EU–US Data Privacy Framework and SCCs. Google Analytics is configured with IP anonymisation enabled.
* **Meta:** SCCs. Meta Pixel data is transferred only with your explicit consent.
* **Anthropic:** SCCs. No Subscriber personal data is sent to Anthropic as part of content generation.

## Section 6 — Data Retention

**Email address and subscription data** Retained for: Duration of subscription + 3 years after cancellation. Reason: Contractual and legal obligation fulfilment; potential dispute resolution.

**Payment transaction records** Retained for: 5 years from transaction date. Reason: Polish tax law and accounting obligations (Art. 74 of the Accounting Act).

**Email engagement data** Retained for: As long as the MailerLite account is active; deleted within 30 days of cancellation upon request. Reason: Legitimate interest in service improvement.

**Website analytics data (Google Analytics)** Retained for: 14 months (Google Analytics default, as configured by the Operator). Reason: Performance monitoring.

**Cookie consent records** Retained for: 2 years. Reason: Demonstration of consent compliance.

After the applicable retention period, personal data is deleted or anonymised. You may request early deletion subject to the provisions of Section 7 below.



## Section 7 — Your Rights Under GDPR

As a data subject under GDPR, you have the following rights with respect to your personal data:

**Right of access (Art. 15)** You may request a copy of all personal data we hold about you.

**Right to rectification (Art. 16)** You may request correction of inaccurate or incomplete data.

**Right to erasure (Art. 17)** You may request deletion of your data where no overriding legal basis for retention exists.

**Right to restriction of processing (Art. 18)** You may request that we restrict processing of your data in certain circumstances.

**Right to data portability (Art. 20)** You may request your data in a structured, machine-readable format where processing is based on consent or contract.

**Right to object (Art. 21)** You may object to processing based on legitimate interests, including direct marketing.

**Right to withdraw consent (Art. 7)** Where processing is based on consent (e.g. cookies), you may withdraw consent at any time without affecting the lawfulness of prior processing.

**Right to lodge a complaint (Art. 77)** You have the right to lodge a complaint with the Polish supervisory authority (UODO) or the supervisory authority in your country of residence.

### How to exercise your rights

## Section 8 — Data Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, destruction, or alteration. These measures include:

* Use of industry-standard, PCI-DSS compliant payment processing through Stripe (we do not store card data).
* Access controls limiting personal data access to the Operator and authorised processors.
* Transmission of data over encrypted connections (TLS/HTTPS).
* Regular review of processor data processing agreements and security practices.

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the UODO within 72 hours and, where required, notify affected individuals without undue delay.



## Section 9 — AI and Automated Processing

Newsletter content is generated with the assistance of AI tools (Anthropic Claude API). This process does not involve your personal data as input — AI models are used solely to research and draft editorial content. No automated decision-making with legal or similarly significant effects (as defined in GDPR Article 22) is applied to Subscribers.

Email engagement metrics (open rates, click rates) may be used to optimise delivery timing and content focus. This optimisation does not constitute profiling for the purposes of GDPR Article 22.



## Section 10 — Children's Privacy

The Service is not specifically directed at children. We do not knowingly collect personal data from individuals under the age of 16 without verifiable parental consent. Where we become aware that personal data of a person under 16 has been collected without appropriate consent, we will delete such data promptly.



## Section 11 — Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated to Subscribers by email at least 14 days before the updated Policy takes effect. The current version is always available on our website. The effective date at the top of this document indicates when the current version came into force.
